All buyers must deliver payment for any and all transactions on the night of sale. Acceptable types of payment are: cash, certified funds, drafts, checks and PIN Debit Cards. Drafts and checks require management approval prior to acceptance. All dealer checks and drafts must be drawn on an account in the name of and belonging to the purchasing authorized automobile dealer. Buying privileges of any dealer or individual having an outstanding dishonored check or draft shall be revoked.

All units purchased "AS IS" must be immediately paid for. All units purchased with a test drive must be paid for within 1 hour.

All title documents submitted by seller must be in seller's name. Foreign titles are unacceptable.
|
All transactions originating on the premises of MID-STATE AUTO AUCTION must be processed through the office and appropriate fees paid.
|
"Title Attached" must be announced on the block if title is not present on sale day.
|
"Conditions" are things not obvious upon visual inspection of the vehicle which must be identified and announced by the seller, if applicable, including but limited to mileage discrepancy, major frame damage, major mechanical defects, salvage history, and reconstruction.
|
Buyer is responsible for verifying serial number and mileage reading on all purchases before leaving sale. No vehicle will be offered for sale without VIN plate.
|
It is the seller's obligation to correct any error made by the auction as to announced "Conditions". It is the buyers obligation to watch lights and to listen to announced "Conditions".
|
All diesels, police cars, taxicabs, municipal cars, fire cars, flood cars, clips, salvage cars, reconstructed cars and boats must be sold under the red light ("AS IS").
|
The auction does not guarantee the year of any camper, motor home, boat, boat motor, dune buggy, truck over two (2) tons or non-USA Spec. Vehicle. Satisfy yourself before settlement, as the auction will not become involved in any subsequent dispute.

All cars must have gate pass before leaving premises.
|
The auction will not become involved in any arbitration, or be responsible for defects on units not sold "under the hammer". Any purchase other than "under the hammer" is an "AS IS" transaction.

The auction does not guarantee any warranty, service policy or mileage.
|
T/A fees will be refunded only if title is delivered the next business day following the sale date.
|
Children are prohibited in the vehicle parking and action areas. Children coming onto auction premises must be attended by an adult.

Light System Rules:

REGARDLESS OF THE COLOR OF THE LIGHT ALL VEHICLES PURCHASED OR SOLD FOR $1500.00 OR LESS ARE SOLD "AS-IS"!

Red Light ("AS IS") Sold with no arbitration. Unit is sold subject to any and all defects.
|
Blue Light ("Title Attached") Assignable title does not accompany car. Seller has up to 40 days to produce title. Buyer is cautioned not to spend any money on unit and not to sell unit until the title is received. After the 40-day period, it is the buyer's option to return the car, or to wait a reasonable additional period of time for the title. When a buyer returns a vehicle because a title has not been timely delivered by the seller for any reason; the seller is responsible for all auction fees due on the transaction. The buyer will be responsible for the expense of returning the vehicle to MID-STATE AUTO AUCTION.

Green Light ("With Drive") Buyer has the right to up-to-one hour test drive the vehicle prior to finalizing sale. Vehicle is subject to arbitration policies.

Arbitration Policy

The following are subject to arbitration unless announced or identified on the block:

Frame damage or frame repairs if reported to the auction within 48 hours of purchase. [Green Light Vehicles ONLY]
|
Engine/Drive train/Defective AC systems if reported prior to leaving the premises.
|
In spite of anything that may be stated otherwise in these rules and policies, cars selling for $1500.00 or less and all diesels are sold "AS IS" and are not subject to arbitration.
